These Terms of Service (“Terms”) govern your access to and use of the website at expressmobilefueling.com (the “Site”) and any fuel delivery services provided by Express Mobile Fueling (“we,” “us,” or “our”). By submitting an inquiry through the Site or entering into a service agreement with us, you agree to be bound by these Terms.
These Terms apply to commercial and business customers only. If you do not agree to these Terms, do not use the Site or our services.
1. Description of Services
Express Mobile Fueling provides on-site mobile fuel delivery services to commercial fleet operators, logistics companies, and performance fleets. Our primary service area spans Los Angeles, Orange, Ventura, Riverside, San Bernardino, and Santa Barbara counties. Services may include the delivery of gasoline (Regular 87, Mid-Grade 89, Premium 91, Super Premium 93), E85 Flex Fuel, and 100 Octane fuel to vehicles at a customer's designated location.
Specific pricing, delivery schedules, fuel grades available, minimum order quantities, and other service parameters are established through a separate written service agreement between Express Mobile Fueling and the customer. The Site and inquiry form are informational only; no binding service agreement is formed until both parties execute a written contract.
2. Eligibility — Commercial Customers Only
Our services are offered exclusively to businesses, fleet operators, and commercial entities. Use of the Site or submission of an inquiry constitutes your representation that you are acting on behalf of a legitimate commercial operation and that you are authorized to bind that business to these Terms.
We do not provide fuel delivery services to private individuals for personal, household, or non-commercial vehicles.
3. Inquiry Submissions
By submitting a fleet inquiry through the Site, you:
Authorize us to contact you at the phone number and email address provided
Confirm that the information you have provided is accurate and complete to the best of your knowledge
Acknowledge that submission of an inquiry does not create a service agreement, obligation to purchase, or guarantee of availability
4. Pricing Structure, Service Tiers, and Logistics
All fuel delivery services are subject to a separate written service agreement. Pricing and service levels follow a tiered structure based on contractual commitment and monthly volume.
A. Pricing Formula
All fuel deliveries are billed using a standardized formula: Total Price = Market Fuel Index + Service Component. The Market Fuel Index is variable and fluctuates based on daily regional energy pricing. The Service Component is established based on the customer's service tier.
B. Service Component Rate Structure
Standard & Preferred Rates: Apply to As-Needed and Month-to-Month accounts, reflecting standard operational margins.
Contract Rate: Applies to Annual (12-month) agreements with monthly volumes between 300 and 1,999 gallons.
Enterprise Rate: Accounts exceeding a 2,000-gallon monthly average qualify for our lowest Enterprise Tier component. If a customer is upgraded to this tier mid-month, pricing is applied retrospectively to the first of the month in which the volume threshold is met.
C. Credit & Payment Terms
Net-30 payment terms are a privilege strictly reserved for the Annual Contract tier and are subject to initial and ongoing creditworthiness as determined by Express Mobile Fueling. As-Needed and Month-to-Month accounts, as well as Annual accounts that do not pass credit review, are subject to "Due on Receipt" terms. We reserve the right to revert any account to "Due on Receipt" status in the event of delinquency.
D. Logistics & Fulfillment Integration
A per-stop Logistics Fulfillment fee applies to all deliveries to cover mobilization costs. This fee is waived exclusively for Annual accounts maintaining a 2,000-gallon monthly minimum. Accounts failing to maintain this volume for two consecutive billing cycles will be subject to standard per-stop fulfillment charges. Priority Route Allocation is reserved for Enterprise accounts and is subject to availability. Pricing and delivery structures may be adjusted if service frequency, volume, or routing conditions materially change.
E. Volume Minimums & Geographic Constraints
A standard 30-gallon minimum applies to all individual delivery stops. This minimum is waived only for Annual accounts maintaining a 2,500+ gallon monthly average. Express Mobile Fueling reserves the right to impose an Extended Zone 100-gallon delivery minimum for dispatches outside of our primary commercial routing corridors or exceeding an approximate 35-mile radius from Downtown Los Angeles to ensure service viability.
5. Customer Responsibilities
Customers receiving fuel delivery services are responsible for:
Providing safe, accessible, and legally permissible delivery locations
Ensuring that vehicles and equipment presented for fueling are in proper condition to receive fuel
Confirming that the correct fuel grade is requested for each vehicle type
Complying with all applicable federal, state, and local regulations regarding fuel storage and use
Promptly notifying us of any changes to delivery location, fleet composition, or scheduling
Express Mobile Fueling reserves the right to refuse service at any location or for any vehicle that poses a safety risk or does not meet applicable requirements.
6. Fuel Spills and Environmental Compliance
Express Mobile Fueling operates in compliance with applicable California environmental and safety regulations. In the event of a fuel spill caused by our equipment or personnel during a scheduled delivery, we will take reasonable steps to contain and remediate the spill and notify appropriate authorities as required. Our delivery systems are specialized for the commercial and high-performance fuel grades specified in Section 1; however, it remains the customer's responsibility to ensure their storage tanks and vehicle receptacles are compatible with the chemical properties of the fuel grade requested (including E85 Flex Fuel and high-octane blends).
Customers are responsible for any spills or releases caused by defective, damaged, or improperly configured customer vehicles or equipment. Customers agree to indemnify and hold Express Mobile Fueling harmless from any claims, losses, or regulatory penalties arising from conditions attributable to the customer's vehicles or property.
7. Acceptable Use of the Site
You agree not to:
Submit false, misleading, or fraudulent information through the Site
Use the Site for any unlawful purpose or in violation of any applicable regulations
Attempt to gain unauthorized access to any part of the Site or its underlying infrastructure
Use automated tools, bots, or scrapers to access or collect content from the Site
Transmit malware, viruses, or any code designed to disrupt or damage the Site
8. Intellectual Property
All content on the Site, including text, logos, graphics, images, and design, is the property of Express Mobile Fueling or its licensors and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from any Site content without our prior written permission.
9. Disclaimer of Warranties
THE SITE AND ALL INFORMATION CONTAINED THEREIN ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXPRESS MOBILE FUELING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Express Mobile Fueling and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site, your submission of an inquiry, or your breach of these Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the exclusive jurisdiction of those courts.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the Site after such changes constitutes your acceptance of the revised Terms. For active service customers, material changes to terms governing your service will be communicated directly.
